NO. Tuning implies setting engine to best manufactures specs without modification. Some people use the term to imply modifications outside manufacturers specs. Georgia Moped class is 50cc scooters restricted to 30mph- I fixed a little Yamaha CA50 for lady in church-it was her little runaround vehicle when she was living in Georgia as teenager. A yamaha Zuma that does 45mph needs motorcycle license endorsement. Tuning to me does NOT include putting 80cc bore kit on former 50cc engine- is a modification that DOT usually wants to be told about to get proper license plates on . Not saying it hasn’t been done without telling DOT–but I know of a few people that have had to pay some expensive tickets when they got caught running derestricted or modified scooters with moped plates still on them.

Probably not. The illegal part is if you change it from a moped (i.e. by increasing the engine size and/or power output and hence top speed) and try to ride it on the wrong license or register it in the wrong class. They legally become motorcycles if you tune them too highly.
