Difference between owning a moped and an electric scooter in Manhattan?

What is the difference between an electric scooter with a seat and a moped? If want to buy something like this, how do I know whether I am buying an "electric scooter" (illegal) or a "moped" (legal)?

A moped has actual pedals, like a bicycle, and a scooter does not. A moped can be ridden without the engine, a scooter uses the motor at all times.

A moped is gasoline powered. The scooters are electric

You are able to ride a moped without a license just like a bicycle, as long as it has pedals. I got one that has OPTIONAL PEDALS. It is perfect!
